Category A – Examples of offences that normally justify a written warning and if repeated warrant more severe action:

Offence Explanation
Absent All freelancer/agents/contract business partners are expected to sign the register at the reception, failure to sign will be deemed as being absent.
Failure to notify Office of his/her Absence from work. All freelancer/agents/contract business partners have a duty to notify the employer of his absence within a reasonable period (at least on the 1st day of absence).
Failing to produce a medical certificate. A medical certificate must be produced for all absences longer than three working days. An employee is expected to obtain and supply such a medical certificate to the company within the stipulated two days.
Poor timekeeping Examples: Reporting late for work, leaving work early, away from the workplace for excessive periods, taking excessive breaks or breaks that are no longer permitted.
Untidy Workplace Failing to keep the work area/workstation clean. Dress code must be appropriate and decent while on duty.
No one is allowed to eat or drink at the radio room or in the offices.
Dereliction of duty Failing to complete a task allocated to the freelancer/agents/contract business partners.
Horseplay Horseplay on company premises or whilst on duty.
Sleeping at work Sleeping at the workplace during working hours.
Negligence/ Poor Workmanship Any act whereby a freelancer/agents/contract business partners, through carelessness or negligence, causes company property to be lost, damaged or misusing assets for a purpose other than that of which they are intended.
Negligence in carrying out duties Failure to carry out duties expected in day-to-day duties.
Failure to submit employment/contract documentation Failure to submit/update documentation required for continued employment i.e. ID, valid PDP, valid driver’s licence.
Abuse, derogatory or insulting language Any verbal/written expression of ridicule or contempt for any person.
Breach of employment contract Any material breach of the business partnership committed by a freelancer/agents/contract business partner, whether intentionally or via negligence.
Failure to carry/use correct equipment Failure to carry/use correct equipment needed for carrying out duties.

FINAL WARNING! Category B – Examples of very serious offences that normally warrant a severe written warning or dismissal:

Offence Explanation
Desertion of post. Refers to a freelancer/agents/contract business partners absenting themselves from their workstation and having no intention to return to work for the remainder of the shift.
Abuse of sick leave. If a freelancer/agents/contract business partner absents himself from duty under false pretenses, e.g.: to conduct private business.
Confidentiality and responsibilities All matters that will discuss in the company premises should remain confidential.
All content creators or freelancers should both On-Air and Podcast must bring their own sponsors.
Media cards are compulsory for any staff member to bring it at work.
Losing your media card will cause your replacement.
Media card and T’ shirt must return to the company while leaving the company.
Media card and T Shirt must not use as personal gain.
All radio presenters must send their weekly prep to the station manager. (prep@1africaradiotv.com)
Staff member without a contract sign are not recognised.
Intimidation and/or incitement. To incite or intimidate other freelancer/agents/contract business partners to use violence, damage company property, adopt unprotected industrial action or indulge in any other disorderly behaviour.
Smelling of alcohol and/or drugs while on duty. The perception of an objective person that the freelancer/agents/contract business partner smells of alcohol and/or drugs. In this case, they are not visually under the influence of alcohol and/or drugs and may be capable of performing his work. Seriousness is directly linked to the nature of the job and consideration must be given to safety hazards and whether the employee works directly with clients.
Insubordination / Insolence Insubordination: an unwillingness to submit to authority, i.e.: directly challenging the authority of a supervisor.
Insolence: disrespect or rudeness toward a supervisor, use of offensive language or manner; in general, being disrespectful.
Non-compliance with prescribed procedure, rules, regulations and/or instructions Pertains to any procedures, rules, regulations, or instructions, including Health and Safety provisions procedures and rules.
Breach of company policy and procedure. A negligent or intentional failure to follow a company policy or procedure that has been implemented.
Unauthorised use of company property. The unauthorised use of any property belonging to the employer, customer, or co-employees.
Failure or refusal to wear a media card or use personal protective equipment. For example, not wearing a media card, reflector, or company uniform.
Wilfully failing to report an accident / injury on duty involving self Any failure to report any work-related accidents or injuries that occurred on duty.
Breach of environmental responsibilities. Not complying with environmental rules and regulations applicable where any work is conducted.
Use of company equipment/material in a manner that endangers own or another’s safety or health. Use of any items in ways that they were not intended to be used, thereby placing freelancer/agents/contract business partners, clients, and members of public in danger.
Disregard of Government or company safety/health/loss control regulations Not complying with safety requirements as specified by legislation or company policies.
Damage to property The intentional or negligent causing of harm/damage to property of the employer, customer or freelancer/agents/contract business partners.
Smoking in prohibited areas Smoking in areas that are prohibited by the employer and/or by legislation.
Bringing the employer's name/business to disrepute. Any conduct that is detrimental to the image and/or good standing of the employer within the perception of the public thereby creating a negative image of the employer.

END OF THE ROAD Category C – Examples of very serious offences that warrant summary dismissal (i.e. dismissal without notice):

Offence Explanation
Desertion and/or the act of absconding from work Absence for a period more than 5 or more days and the employee, despite being requested to do so, failed to contact the employer to inform him of the reason for absence.
Sexual harassment Behaviour of a sexual nature, affecting the dignity of women or men at work. Such behaviour is unacceptable if it is unsolicited, unreasonable and/or offensive. The conduct creates an intimidating, hostile and humiliating situation.
Assault / attempted assault Causing or attempting to cause bodily harm to any other person. The action to be taken is dependent upon, inter alia: Provocation, self-defence, intention and nature and severity of injury sustained.
Sabotage Incidents where freelancer/agents/contract business partners deliberately sabotage the employer.
Unprotected strike action Work stoppages that occur without following the legislated dispute resolution procedures.
Alcohol / blood content above 0,05 The results of a breathalyser test indicating an alcohol / blood content ratio exceeding a reading of 0,05.
Under the influence of intoxicating liquor / drugs while on duty Incapable of working properly whilst under the influence of alcohol and/or drugs or reporting for work in an unfit condition whilst under the influence of alcohol and/or drugs.
Unauthorised consumption of intoxicating liquor / drugs while on duty The actual consumption of liquor or drugs on duty without the necessary permission or authority.
Unauthorised / illegal possession of liquor or drugs while on duty The actual possession of liquor or drugs while on duty without the necessary permission or authority.
Gross insubordination A serious act of refusing to comply with a reasonable and lawful instruction.
Gross insolence A serious act of insolence that has as its element’s wilful contempt of the employer’s authority.
Divulging confidential information Revealing confidential information means unauthorised presentation, a revealing discussion, press release, publication and/or any communication whatsoever that could result in hardship to the company.
Giving false evidence, making a false statement or declaration, supplying false documentation When a deliberate attempt is made to mislead or defeat the ends of justice through misrepresentation of a fact, either verbally or in writing. This includes submitting a false medical certificate.
Bribery / Corruption Giving or receiving or attempting to give or receive any bribe / money to perform any corrupt / dishonest act that will be to the detriment of the company or that will result in personal gain.
Fraud / Forgery Any wilful misrepresentation by any employee with a view to derive personal gain in whatever form and/or damage or harm or potentially damage or harm the company.
Misappropriation The incorrect application of company funds, assets or property for reasons of personal gain and/or any other such purpose.
Unauthorised possession Being in possession of any funds, assets or property belonging to the company, clients, or freelancer/agents/contract business partners without any due authorisation.
Duplication Staff member is not allowed to work in any radio station while you're still in 1 Africa radio tv investment.

END OF THE ROAD Category C – Examples of very serious offences that warrant summary dismissal (i.e. dismissal without notice): Continues:

Offence Explanation
Unauthorised consumption The unauthorised consumption of any property belonging to the employer, customers, or co-employees without due authorisation.
Theft The unauthorised removal or taking of property other than the employee’s own, irrespective of who the rightful owner is.
Competing with the employer and/or conflict of interest Acting contrary to the best interest of the employer in disclosing confidential information to a competitor of the employer and/or conducting business in competition to the employer and/or failing to disclose an interest in a competing business to the employer.
Possession of dangerous weapon Possession of a dangerous / offensive weapon or material without authority from a responsible manager.
Dishonesty Any dishonest act performed by the freelancer/agents/contract business partners which causes a breakdown of trust.
Fighting No one is allowed to engage or attempt to fight anyone within the company or outside company premises while on duty.
Disclosing confidential information No one is allowed to share any company information with a third party without the consent and approval of the Chief Executive Officer while employed by the company and afterwards.
Competing with the employer / conflict of interest No one is allowed to engage with company clients or prospective clients for personal gain or to share any company information or information and skills acquired while working for the company.
